Invoicing
Invoices for mediation fees will be sent to the parties once the mediation date has been set and are payable within 7 days of receipt (and in any event no later than 7 days prior to the mediation date). Failure to settle invoices within 7 days of the mediation may lead to the postponement of the mediation at the discretion of SettleMyDispute Ltd and the cancellation fees may then apply as detailed in these Terms & Conditions.
If the mediation has been scheduled at short notice (less than one week prior to the mediation) special arrangements must be agreed with us to ensure payment is made before the mediation commences.
Unless a party is acting in person, invoices will be addressed to and payable by the solicitors or other lead advisers of each party with whom arrangements are made for the mediation.
Cancellation and postponement charges
In the event of cancellation or postponement by either party received by SettleMyDispute in writing the following charges apply:
1. Fourteen days or less but more than seven days before the mediation was due to take place, SettleMyDispute Ltd will be entitled to: 50% of the mediation fees and all expenses incurred in relation to the mediation
2. Seven days or less but more than one working day before the mediation was due to take place, SettleMyDispute Ltd will be entitled to: 75% of the mediation fees and all expenses incurred in relation to the mediation
3. One working day before the mediation was due to take place or less, SettleMyDispute Ltd will be entitled to: 100% of the mediation fees and all expenses incurred in relation to the mediation.
The parties are jointly and severally liable for cancellation fees unless agreement to alternative arrangements is reached with SettleMyDispute Ltd and recorded in writing. Such agreement must be reached within 5 working days of appointment or prior to the mediation taking place if the mediation has been arranged at short notice.
Expenses
All expenses related to the mediation such as the mediator’s travel expenses are charged at cost or £0.45 per mile if driving.
VAT
VAT is not currently charged on our costs.
What if I am not satisfied with the service I receive?
SettleMyDispute Ltd aims to provide a very high standard of service both in the mediation and in respect of administration. If you are dissatisfied in any way, please contact SettleMyDispute Ltd including your full name, the names of all the parties in the mediation, the date of the mediation, and any documents relevant to your concerns. We will provide a response within 14 days and invite further discussion as to what can be done to meet your concerns.
